Effective October 26, 2026. You are reading this on FableWatch. These Terms cover both ArtificialWatch (artificialwatch.com) and FableWatch (fablewatch.com); a section that applies to only one of them says so.

What changed on October 26, 2026: for a yearly ArtificialWatch plan, we now email you a reminder about 30 days before each renewal (Section 5.1).

What changed on October 16, 2026: we now name the company you contract with (Mark Studios, LLC); ArtificialWatch subscriptions, automatic renewal, cancellation and the phone-call credit are set out in Section 5; FableWatch's paid plans are closed to new buyers; and disputes now go to the courts in Palm Beach County, Florida, instead of arbitration (Section 12).

1. Who we are

These Terms of Service (“Terms”) are an agreement between you and Mark Studios, LLC, a Florida limited liability company (“Mark Studios”, “we”, “us”). ArtificialWatch and FableWatch are services of Mark Studios, LLC (together, the “Services”). Contact: contact@fablewatch.com · 7901 4th St N, Ste 300, St. Petersburg, FL 33702, USA.

By using the Services you agree to these Terms and acknowledge our Privacy Policy. When you subscribe, you accept them by ticking the automatic-renewal box and clicking the subscribe button. If you do not agree, do not use the Services.

2. Who can use the Services

You must be at least 18 and able to enter a binding contract. If you use the Services for a business, you confirm you can bind it, and “you” includes that business.

3. What the Services are, and what they are not

ArtificialWatch is an independent news and alert service about AI model releases. It publishes a watchlist, model pages, the wire, benchmark tables and prediction-market prices, and sends alerts by email and browser push, and, on paid plans, by text message and an automated phone call. The Watchtower plan also runs prompts you choose against new models through third-party model providers and has another model score the answers.

FableWatch is an independent monitor for Anthropic's Fable and Mythos-class models with a sourced news timeline and a free email alert. Its paid plans (The Signal and The Swarm) are closed to new buyers (Section 5.4).

Independence. FableWatch is an independent news and monitoring service operated by Mark Studios, LLC. It is not Anthropic and is not affiliated with, endorsed by, or sponsored by Anthropic, PBC. Claude and other Anthropic product names are trademarks of Anthropic, PBC, used here only to identify Anthropic's models. Reports about government actions are attributed to the cited news outlets and may be unconfirmed.

No guarantee of timing or accuracy. We detect launches by watching third-party APIs, catalogs and public sources, which can change, fail or mislead. An alert can be late, missed, duplicated or wrong, and a report can be a rumour or leak, which we label as such. Benchmark tables, prices and prediction-market odds are shown for information only, may be out of date, and are not financial, investment or purchasing advice. We earn nothing from any prediction market.

4. Alerts, messages and your links

Email. You receive the alerts you chose. On the free plan, ArtificialWatch launch alerts by email and browser push go out about 15 minutes after paid members' alerts; paid plans get them as soon as a launch is confirmed. Some emails also mention our paid plans or our other Service; if you are in the EU, EEA, UK or Switzerland we send you product news only with your consent. Every email has a one-click unsubscribe link.

Text messages and calls. We text or call only a number you added and verified in your dashboard after ticking the separate consent box. The Messaging Terms apply. Reply STOP to any text to stop texts and calls; message and data rates may apply. Consent to texts and calls is never a condition of purchase.

Your private links. The dashboard link in our emails works without a password. Treat it like a key and don't share it; anyone holding it can change your preferences. Ask us for a new one if it leaks.

5. Paid plans

5.1 ArtificialWatch subscriptions (Signal, The Call, The Watchtower). These are subscriptions, not one-time purchases. The price and billing period (monthly or yearly) are shown above the subscribe button and on Stripe's checkout page. You are charged when you subscribe (or, on a plan with a free trial, when the trial ends) and then automatically every month or every year, at the same price, until you cancel. Free trials: Signal starts with a 7-day free trial. We collect your payment method at checkout and charge the plan's price when the trial ends unless you cancel before then; cancelling during the trial costs nothing and ends your access when the trial does. One free trial per person. We email you a reminder about 30 days before each yearly renewal, with the renewal date, the amount we will charge and a link to cancel online. Taxes, if any, are added at checkout. Payments are processed by Stripe; we never see your full card number.

5.2 Cancelling. You can cancel at any time online: open your dashboard and choose “Manage billing” (the link is also in every paid-plan email), or email contact@fablewatch.com with “Cancel” and we will confirm within one business day. Cancelling stops all future charges. You keep your plan until the end of the period you have already paid for.

5.3 Refunds, price changes and upgrades. Except for the credit in Section 5.5, a charge made in error, or where the law requires otherwise, payments are not refundable and we don't refund part of a billing period. If you were charged after you cancelled, we refund that charge. If we change a plan's price, we email you at least 7 days (and no more than 30 days) before the new price applies to you, so you can cancel first. Charter rates: The Call's $19.99 a month, The Watchtower's $34.99 a month and the closed Founding plan's $9 a month do not rise for as long as that subscription stays active; a subscription that is cancelled or ends for non-payment loses its charter rate. Upgrading to The Watchtower from your dashboard ends your current plan, and its unused days are credited to your next Watchtower invoice.

5.4 FableWatch one-time purchases (closed). The Signal ($9) and The Swarm ($99) were one-time purchases. They are closed to new buyers and cannot be bought. If you bought one, the 90-day promise still applies: if no watched model event fired the alert you paid for within 90 days of your purchase, email us and we refund that purchase in full. Any model usage on your own Anthropic API key was billed to you by Anthropic and is not refundable by us.

5.5 The phone-call credit (The Call and The Watchtower). If a flagship launch that we confirm and alert on does not ring your verified phone because of a fault on our side, tell us within 30 days and we will credit one month's fee for that billing period (for a yearly plan, one twelfth of the yearly price). This applies only if your number was verified and the call was switched on for that model at the time, and not when your quiet hours held the call, or your carrier or phone blocked or missed it. At most one credit per billing period; we apply it to your next invoice, or refund it if you have cancelled.

6. Acceptable use

Don't misuse the Services: no scraping or automated bulk access beyond the public data files we publish, no attempts to break security or rate limits, no signing up other people's email addresses or phone numbers, and nothing unlawful. We may suspend accounts that do.

7. Your content and our content

Prompts you give the Watchtower stay yours. You let us store them and send them to the model providers needed to run and score them, only to provide the Watchtower to you. Do not include confidential information or other people's personal data in them.

Our content (text, design, data tables, code and the ArtificialWatch and FableWatch names and marks) belongs to Mark Studios, LLC or its licensors. You may link to and quote short extracts with attribution. The open data files we publish carry their own licence notes. Third-party names and marks belong to their owners and are used only to identify their products.

8. Third-party services

The Services rely on and link to third parties (for example Stripe, Twilio, model providers and prediction markets). Their terms govern your use of them, and we are not responsible for their content or availability.

9. Disclaimer

Except as expressly promised in these Terms, the Services are provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy and uninterrupted availability, to the extent the law allows.

10. Limitation of liability

To the extent the law allows: we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or opportunity; and our total liability for any claim about the Services is limited to the amount you paid us for the Service concerned in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, including for fraud, gross negligence, or death or personal injury caused by negligence, or the mandatory rights of consumers in the EU and UK.

11. Indemnity, suspension and ending

If you break these Terms or the law in using the Services and a third party claims against us as a result, you will cover our reasonable losses and costs. We may suspend or end your access for a serious or repeated breach; if we end a paid plan without your fault, we refund the unused part. You can stop using the Services at any time and ask us to delete your data (see the Privacy Policy). We may change or discontinue a feature; if we discontinue a paid plan, we stop billing it and refund any period paid in advance that we can no longer provide.

12. Disputes

Talk to us first. Before filing any claim, email contact@fablewatch.com describing it, and give us 30 days to try to resolve it informally.

Law and courts. These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute must be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small-claims court where it qualifies.

TO THE EXTENT THE LAW ALLOWS, YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL, AND CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION.

Time limit. Where the law allows, a claim must be brought within one year after it arises.

EU and UK consumers keep the protection of the mandatory laws of the country where they live and may bring proceedings in their local courts.

13. Changes to these Terms

We may update these Terms. We post the new version here with a new effective date and a short note of what changed, and for a material change to a paid plan we email subscribers at least 14 days before it applies. If you don't accept a change, cancel before it takes effect.

14. General

These Terms, the Privacy Policy and the Messaging Terms are the whole agreement between us about the Services. If a provision is unenforceable, the rest still applies. Our not enforcing a provision is not a waiver. You may not transfer these Terms; we may transfer them to a successor of the Services, with notice to you. Notices to you go to your email address; notices to us go to contact@fablewatch.com or by mail to Mark Studios, LLC, 7901 4th St N, Ste 300, St. Petersburg, FL 33702, USA.

California residents: under Cal. Civ. Code 1789.3, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
